1. GENERAL PROVISIONS
1.1. The www.komiksy.edu.pl Online Store is run and administered by the entrepreneur:

website: komiksy.edu.pl The e-mail address shop@komiksy.edu.pl – is the address at which Customers can contact the Entrepreneur – hereinafter referred to as “Entrepreneur”, “Online Store” or “Service Provider”, or The “store”.
1.2. It is considered that reading and accepting these regulations is tantamount to providing information by the Entrepreneur to the consumer (Customer) referred to in art. 12 of the Act of May 30, 2014 on consumer rights – Journal Of Laws of 2014, item 827), this information is included in the following sections of the regulations.
1.3. Customer:
a) a natural person over 18 years of age with full legal capacity,
b) a minor who is at least 13 years of age but under 18, and if the person is under 18, the consent of their legal representative is required,
c) a legal person and an organizational unit that is not a legal person, the specific provisions of which grant legal capacity, and which places or intends to place an order in the online store, hereinafter referred to as the “Customer” or the User.
1.4.
1.5. Order – Customer’s declaration of intent, aimed directly at the conclusion of a Product Sales Agreement at a distance via the Online Store, specifying: the type and number of products ordered, the total price for the products, as well as the costs of delivery of the ordered Products to the Customer.
1.6. Product – a movable item covered by the Sales Agreement.
1.7. Sales Agreement – a contract for the sale of products within the meaning of the Civil Code and the Consumer Rights Act, concluded at a distance between the Entrepreneur and the Customer, using means of distance communication.
1.8. Civil Code – Act of April 23, 1964 (Journal of Laws of 1964 No. 16, item 93, as amended).
1.10. Consumer Rights Act – the Act of May 30, 2014. (Journal of Laws of 2014, item 827).
1.11. In terms of services provided electronically, these Regulations are the regulations referred to in Art. 8 of the Act of July 18, 2002. on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended).
1.12. The condition to start using the Store is to read these Regulations and its full acceptance.
1.13. Contact with the store service is possible:

1.14. The store operates in Polish and in English.

2.1. Placing an Order is possible only by Users of the Online Store who have correctly completed the registration form on the Online Store website.
2.2. The registration form requires the provision of the following data: name, surname, delivery address, e-mail address, contact telephone number. Incorrect filling in the form or providing incorrect data may result in the Online Store’s withdrawal from the contract. Failure to exercise due diligence when filling in the form may result in the need for the Customer to incur additional costs, including: costs of a compensation nature, costs of incorrect shipment, costs of re-shipment, and other reasonable costs that have been incurred by the Store in order to complete a given order.
2.3. Orders can be placed 24 hours a day. Placing an order entails an obligation to pay. The order is processed within a maximum of 7 business days from the date the payment for the ordered product is credited to the bank account, Przelewy24 or PayPal account belonging to the Entrepreneur. However, the Store staff will make every effort to shorten the delivery time to a minimum.
2.4. The condition for accepting the order for execution by the Online Store is the submission of the Order and payment of the resulting amount due for the conclusion of the Sales Agreement.
2.5. Acceptance of the Order for execution is each time confirmed by the Online Store by a return e-mail sent to the e-mail address provided by the Customer in the registration form and is tantamount to concluding a Sales Agreement. Another confirmation is sent after the payment for the concluded Sales Agreement has been booked. In the case of payment of the amount due and no confirmation, please contact the shop: shop@komiksy.edu.pl or by calling + 48 691099246 between 9.00 a.m. and 5.00 p.m.
2.6. In the event of circumstances preventing the implementation of the order, the Store reserves the right to suspend its implementation, and undertakes to immediately notify the Customer about the situation.
2.7. The store carries out orders in the territory of the Republic of Poland and countries included in the list that appears with the order.
2.8. All prices are given in Polish zlotys or euros and include VAT. The prices do not include the costs of delivering the product to the customer, which are given separately.
2.9. In the event of a change in the prices of goods, the Order will be processed at the price applicable at the time of placing the Order.
2.10. Consolidation, security and disclosure of essential provisions of contracts concluded by means of distance communication takes place by providing the customer with a proof of purchase. The proof of purchase may be sent in electronic form or together with the order.
2.11. The Store reserves the right to change the prices of goods on offer, introduce new goods to the online store’s offer, remove existing goods from the Store, carry out and cancel promotional campaigns on the Store’s websites, or make changes to them.
2.12. The order will be processed provided that the goods are in stock.
2.13. Promotions or discounts in the Store cannot be combined, unless the Regulations of a given promotion provide otherwise.
3. PAYMENTS
3.1. The store accepts payments using:
a) Przelewy24 service,
b) PayPal service,

3.2. Payments for the ordered goods should be made immediately, so that the amount due is credited to the Online Store’s account within a maximum of 7 working days from the date of placing the order. In the absence of the payment due for the conclusion of the sales contract within the period referred to above, the order is considered canceled and the Online Store will not proceed with its implementation.
3.3. Transactions supported by Przelewy24 and PayPal ensure the highest level of security. Modern data encryption methods combined with a world-class hardware platform guarantee the reliability of transactions. Information on the rules of making payments via these portals can be found at: www.przelewy24.pl, www.paypal.com/pl/home.
4. SHIPMENT
4.1. Deliveries are made on working days via the InPost courier company, both as traditional courier parcels, as well as in the form of parcels delivered to InPost parcel lockers (on the territory of Poland). The shipping cost is PLN 9 gross (courier) or PLN 9.50 gross (Inpost Paczkomaty). Information on the terms and conditions of the services provided can be found at: www.inpost.pl. The delivery time is 2-3 business days.
4.2. Foreign shipments are made via Poczta Polska. The cost of shipping abroad is fixed at 10 euros.
4.3 The shipping costs of the purchased Goods are borne by the Customer, only in the case of purchasing 18 comic books of one series, the shipping costs are covered by the Online Store.
4.4. Before collecting the parcel, the Buyer is obliged to check that the parcel has not been damaged during transport. If it has been damaged or there is such a suspicion, a complaint protocol should be drawn up in the presence of the courier before signing the receipt of the package. Checking the shipment on delivery is a necessary condition for considering any claims of the Buyer for damage to the shipment in transit. The courier company is responsible for complaints regarding damage caused during transport.
4.5. The claim for improper performance of the postal / courier service expires as a result of accepting the postal item without reservations, unless the defects or damage to the postal item that cannot be noticed from the outside was stated by the customer after accepting the parcel and not later than 7 days after accepting the parcel, reported it to the courier company, or the postal operator the claim in this respect and proved that the losses or damage to the parcel arose in the time between the receipt of the parcel by the courier / postal operator for the purpose of providing the postal service and its delivery to the addressee. The Online Store should also be immediately notified of this fact.
4.6. If the Customer does not pick up the Product ordered by him, he will cover the costs of sending it back to the Store.
5. RETURN (WITHDRAWAL FROM THE CONTRACT) AND COMPLAINTS
5.1. The entrepreneur undertakes to provide the Customer with the products purchased by him without defects.
5.2. Return (Withdrawal from the contract):
5.2.1. You have the right to withdraw from this contract (return it) within 14 days, without giving any reason. The deadline for withdrawing from the contract will expire after 14 days from the day on which you came into possession of the goods.
5.2.2. To exercise the right to withdraw from the contract, you must inform us about it, for example by sending a letter by post to the following address:

5.2.3. You can use the ready-made model withdrawal form (available for download HERE).
5.2.4. The goods should be returned immediately, but no later than 14 days from the moment the Store is informed about the exercise of the right to withdraw from the contract.
5.2.5. The goods should be originally packed and show no signs of use.
5.2.6. In the event of withdrawal from this contract, we will refund all payments received from you, including the costs of delivering the goods to you. We will refund the payment using the same payment methods that you used in the original transaction, unless you have expressly agreed otherwise.
5.2.7. The costs of returning the Product to the store in connection with the withdrawal from the contract are borne by the Customer. 5.3. Complaints
5.3.1. If the products have defects in the nature of non-compliance with the contract, the complaint may be submitted by returning the goods together with the complaint form (download HERE) and proof of purchase, by post or by registered mail to the following address: Simon says, street. In the event of a positive consideration of the complaint submitted by mail, the Store will send the customer a full-fledged product (repaired or new) within 14 days, and if it turns out to be impossible, it will refund the full amount paid for the goods, including shipping costs.
5.3.2. In the event of a negative consideration of the complaint, the goods will be returned to the customer together with the refusal of the complaint and its justification.
5.4. The store does not accept any parcels sent COD.
6.FINAL PROVISIONS
6.1. In matters not covered by these Regulations, the following provisions shall apply:
a) Consumer Rights Act – the Act of May 30, 2014. (Journal of Laws of 2014, item 827)
b) The Act of April 23, 1964, Civil Code – (Journal of Laws of 1964 No. 16, item 93, as amended)
6.2. There is a code of good practice referred to in Art. 2 point 5 of the Act of August 23, 2007. on counteracting unfair market practices (Journal of Laws of 2007, No. 171, item 1206), which can be found in the Internet Legal Acts System at www.isap.sejm.gov.pl.
6.3. By placing an Order, the Customer accepts these Regulations.
6.4. The law applicable to these Regulations is Polish law.
6.5. The store reserves the right to amend these Regulations. Amendments to the Regulations are effective from the moment they are published on the Store’s website.
6.6. Differences in the appearance of a given product between the product visible on the Store’s website using the Customer’s computer and the product received by the Customer, resulting from the individual settings of the Customer’s computer (color, proportions, etc.) cannot be the basis for a complaint about the purchased product.
6.7. The Seller makes every effort to ensure that the services provided as part of the Online Store are at the highest level, however, it does not exclude the possibility of temporarily suspending the Store’s availability in the event of the need for maintenance, inspection, replacement of equipment or in connection with the need to modernize or expand.
6.8. All products and names on the Store’s website are used for identification purposes and may be protected and reserved under the provisions of the Industrial Property Law Act (Journal of Laws No. 119 of 2003, item 1117). The proprietary copyrights to graphic elements, including the e-future logo, as well as to the layout and composition of these elements (the so-called layout) are vested in e-future Monika Kopacz. It is forbidden to use graphic elements, their layout and composition, as well as markings that are subject to the rights of e-future Monika Kopacz.
7.ADDITIONAL INFORMATION ON THE EXERCISE OF THE RIGHT TO WITHDRAW FROM THE AGREEMENT
7.1. The right to withdraw from the contract
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.
7.2. To exercise the right to withdraw from the contract, you must inform us:

of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the model withdrawal form (download HERE), but it is not obligatory. To keep the deadline for withdrawing from the contract, it is enough for you to send information regarding the exercise of your right to withdraw from the contract before the deadline to withdraw from the contract.
7.3 Consequences of withdrawal from the contract:
In the event of withdrawal from this contract, we will reimburse you all payments received from you, including delivery costs (except for additional costs resulting from the method of delivery chosen by you other than the cheapest standard delivery method offered by us), immediately, and in any case no later than 14 days from the date on which we were informed about your decision to exercise the right to withdraw from this contract. We will refund the payment using the same payment methods that you used in the original transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of this reimbursement.
We may withhold the reimbursement until we receive the item, or until proof of its return is provided to us, whichever occurs first.

The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods You are only responsible for reducing the value of things resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of things.
